Terms of Use

1. Introduction
Welcome to Insura Sdn Bhd (Company No:1434548-K) ("Company", "we", "our", "us"). These Terms of Use ("Terms" or "Agreement") govern your use of INSURA mobile application, website, digital products or services, content, facilities, and platform (collectively, the "Platform"). By accessing or using our Platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our Platform.
By using our Platform, you affirm that you are of legal age to enter into a binding agreement with us have the legal capacity to comply with these Terms. If you are accessing or using our Platform under the supervision of a parent or guardian, their consent and supervision are required. Minors may only use our Platform with parental or guardian consent and oversight.
If you are using the Insura App on behalf of an entity, you further represent and warrant that you have the necessary authority to bind that entity to these Terms.
Continuing to use our Platform signifies that you have read and accepted these Terms of Use. If you disagree with any part of these terms, please discontinue your use of our Platform. It is important to read these terms carefully as they govern your relationship with us.
2. About Insura App
2.1 Our Business Model
With the aim of facilitating passive income generation and creating more savings, the Insura App is an all-in-one membership platform designed to reward members—users who have subscribed to any of Insura's Digital Networking Programs—with exciting and exclusive perks. Members can manage their profiles, view referral statistics, access support, and earn points by referring others to Insura's Digital Networking Programs. Accumulated points can be utilize for comprehensive insurance or Takaful protection at no additional cost and can be converted to cash payouts, subject to the relevant terms and conditions.
Insura is a technology company and is not an insurance aggregator, broker, agent, or provider. Our primary function is to offer a platform where members can participate in the Insura Referral Program and earn rewards, which may include insurance or Takaful benefits.
2.2 Insurance/Takaful Rewards
While Insura offers insurance or Takaful protection as part of its rewards program, it does so solely as a benefit to its members. These benefits are provided in partnership with third-party insurance or Takaful providers. Insura does not underwrite, issue, or manage any insurance or Takaful policies directly. All insurance or Takaful products offered as rewards are subject to the terms and conditions set forth by the respective third-party providers.
2.3 No Advisory Role
Insura does not provide insurance advice or recommendations. Any information provided on the Insura App or Website regarding insurance or Takaful products is for general informational purposes only. Members should consult directly with the third-party providers for detailed information about coverage, terms, and conditions.
2.4 Member Responsibilities
Members are responsible for understanding the terms and conditions of the insurance or Takaful products they receive as rewards. It is the member’s responsibility to ensure that they meet any requirements and understand the coverage details, exclusions, and limitations of these products. Insura encourages members to review all relevant documents and consult with the third-party providers if they have any questions or concerns.
2.5 Limitation of Liability
Insura shall not be liable for any losses, damages, or claims arising from or related to the insurance or Takaful products offered as rewards. This includes, but is not limited to, any issues related to policy terms, coverage disputes, claim denials, or other matters managed by the third-party providers. Members acknowledge and agree that their sole recourse for any insurance or Takaful-related issues is with the third-party providers.
3. Supplemental Policies
By accessing or using our Site and/or App, you agree to comply with the following additional terms and policies:
a) Privacy Policy: Details on how we collect, use, and disclose personal data can be found in our Privacy Policy, available at [www.insura.com.my or Privacy Policy]. Please review this policy to understand our practices regarding your personal information.
Additional terms and conditions may apply if you subscribe to any of our products and services.
4. Amendments to Terms
Insura (M) Sdn Bhd reserves the right to amend the terms of this Agreement from time to time. Any amendments will become effective upon Insura’s posting of the updated terms at this location or the amended policies or supplemental terms on the applicable service. Your continued access or use of the Platform and/or Services after such posting constitutes your acceptance of the revised terms.
5. Account Creation and Maintenance
5.1 Account Registration
In order to access the functionality and features of Insura App ("App") and the services therein, you must register yourself as a member of the App for a valid account ("Insura Account") and accept these "Terms of Use" ("Terms").
To create and maintain your Insura Account, you represent and warrant that you:
a. Are at least 18 years old;
b. Have the legal capacity to enter into a binding agreement under the applicable laws of Malaysia;
c. Will ensure that your device meets all the technical and operational requirements necessary to use the Platform. These requirements may change from time to time, and it is your sole responsibility to ensure your device remains compatible. The use and performance of the Platform may be affected by these specifications.
To complete the registration process on the Insura App ("App"), users will be prompted to upload specific documents on the post-registration page, including but not limited to:
proof of identity, such as an IC (Identification Card), passport, or driver's license (either one),
as well as proof of address, such as utility bills or bank statements.
You agree to provide accurate and current information about yourself and authorize us to take any necessary actions to verify the accuracy of the information submitted with your account. You also agree to assist us reasonably in verifying such information upon our request.
Insura shall bear no liability for false, incomplete, old or incorrect information and/or data provided by you while opening your account.
5.2 Account Maintenance
You are responsible for maintaining the security and confidentiality of your Insura Account credentials and for all activities that occur under your Insura Account.
If you become aware of any unauthorized use/access to your account or suspect any breach of security, you must promptly notify Insura and take appropriate measures to secure your account. Until Insura actually receives such notification and verifies your identity, you shall remain responsible for any access and all use of the App or benefits received via programmes by the unauthorised person.
Insura shall not be liable for any losses or damages arising from unauthorized access to or use of your account, except where such access or use is directly caused by Insura's negligence or willful misconduct.
You are permitted to open only one account using the registration information you provide. If you suspect any unauthorized use of your account, please reach us via Help Center by submitting a ticket pertaining to related issues.
The processing of your personal data by Insura pursuant to your registration with and use of the App shall be subject to the privacy policy as published by Insura on its website and also available within Insura App. The Privacy Policy shall form part of these Terms.
5.3 Account Termination
Insura reserves the right to suspend or terminate your access to the Insura App at any time if we have a reason to believe that any information and/or data provided by you is incorrect or false, or that the security of your account has been compromised in any way, or for any other reason and for any reason, including but not limited to violations of these Terms.
Upon termination, all licenses and rights granted to you under these Terms will immediately cease, and you must stop all use of the Insura App.
5.4 Payment and Fees
Certain features or services within the App may require payment of fees. You agree to pay all applicable fees as described in the App. Your continued use of the Platform will constitute your acceptance of the updated fees.
Insura reserves the right to modify the fees and payment terms at any time upon notice to you.
Service Fees: Insura charges a payout service fee of 5% per transaction. This fee will be automatically deducted from the total amount of each payout transaction to cover processing and administrative costs.
Payment Processing Fees: As we integrate with STRIPE for payment processing, any fees associated with program subscriptions are subject to STRIPE’s payment terms and fees. These fees are in addition to any service fees charged by Insura.
Payment Authorization: By providing payment information and using the Insura App, you authorize Insura and its designated payment processors, including STRIPE, to charge the applicable fees to your designated payment method. You are responsible for ensuring that the payment information you provide is accurate and up-to-date.
Fee Modifications: Insura reserves the right to modify the fees and payment terms at any time upon notice to you. Any changes will be communicated through the App or other appropriate channels. Your continued use of the Platform after such notice constitutes your acceptance of the updated fees and payment terms.

6. Prohibited Activities
You agree to use the Insura App solely for its intended purposes and in compliance with all applicable laws and regulations.
You shall not engage in any activities that may:
Interfere with or disrupt the operation of the Insura App;
Infringe upon the rights of others;
Violate the privacy or intellectual property rights of others;
Transmit, distribute, or store any content that is unlawful, defamatory, obscene, or harmful;
Attempt to gain unauthorized access to the Insura App or its related systems.
Impersonate another person or log into an account which you are not authorised to access;
Use or attempt to use another user’s account without authorisation from that user;
Interfere or attempt to interfere with service or any user, host or network, including by way of introducing a virus, overloading, “flooding”, or crashing, sending unsolicited email, promotions or advertisements;
Reverse engineer, decompile, or disassemble any aspect of the App and/or website or do anything that might discover source code or bypass or circumvent measures employed to prevent or limit access to any part of the App and/or website; or
Develop or use any third-party applications that interact with the App and/or website without our prior written consent, including any scripts designed to scrape or extract data from the App and/or website.
7. Intellectual Property Rights
7.1 Ownership
All content available on the Insura App and Website, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and other materials (collectively, "Content"), is the property of Insura or its content suppliers and is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws or processes.
7.2 Licenses Grant & Restrictions
Subject to your compliance with these Terms, Insura grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Insura App and Website. This license includes the right to participate in the Insura Referral Program, which allows you to earn rewards by referring others to Insura’s Digital Networking Programs through your unique referral links or codes.
This license does not include any other resale or commercial use of the Insura App or Website, or its Content; any collection and use of any product listings, descriptions, or prices; any derivative use of the Insura App or Website, or its Content; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Terms are reserved and retained by Insura or its licensors, suppliers, publishers, rightsholders, or other content providers.
The Insura App and Website, or any portion of the Insura App and Website, may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose other than as expressly permitted herein without express written consent of Insura.
8. Discretionary Rights of Insura
Insura may provide updates and/or modifications to the App, or change, suspend, or discontinue all or any part of the Insura App from time to time at its sole discretion without prior notice to you.
Insura may, at its sole discretion, remove or edit any content within the App or terminate or suspend any user's access to the App for any reason, including but not limited to a breach of these Terms.
9. Insura Communications
By using the Insura App and Website, you consent to receive communications from Insura via email, SMS, phone, and push notifications. These communications may include account updates, legal notices, promotional messages, and other relevant information.
It is your responsibility to ensure that the email address associated with your Insura Account is accurate and up-to-date, and that you regularly check for updates and communications from Insura.
10. Liability
10.1 Insura’s Limitation of Liability
To the fullest extent permitted by law, Insura, its officers, directors, employees, agents, and affiliates, shareholders, subsidiaries, licensees, licensors, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Insura App and Website; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Insura App and Website; (iv) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Insura App and Website by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Insura App and Website; and (vi) any user content or the defamatory, offensive, or illegal conduct of any third party.
10.2 User’s Liability
You are solely responsible for their use of the Insura App and Website, including any content or materials they submit, post, or transmit. You agree to use the Insura App and Website in accordance with all applicable laws, regulations, and these Terms.
You agree to indemnify, defend, and hold harmless Insura, its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including, but not limited to, reasonable attorneys' fees and court costs) arising out of or related to their use or misuse of the Insura App and Website, any violation of these Terms, any violation of applicable laws, rules, or regulations, any breach of representations, warranties, and obligations, and any content or material submitted, posted, or transmitted, including claims of infringement or misappropriation of intellectual property or other proprietary rights.
10.3 Disclaimer
The Insura App and Website, including all content, software, functions, materials, and information made available on or accessed through the Insura App and Website, are provided "as is."
To the fullest extent permissible by law, Insura makes no representations or warranties of any kind whatsoever for the content on the Insura App and Website or the materials, information, and functions made accessible by the software used on or accessed through the Insura App and Website.
Insura does not warrant that the functions contained in the content, information, and materials on the Insura App and Website or any third-party sites or services will be uninterrupted or error-free, that defects will be corrected, or that the Insura App and Website or the servers that make them available are free of viruses or other harmful components.
11. Resolving Disputes
This Agreement is governed by the law of Malaysia. In the event of a dispute, we will first attempt to resolve it amicably with you. Any disputes, claims, or controversies arising out of or relating to these Terms, the Insura App, or your use of the services provided by Insura, including disputes relating to its validity, breach, termination, or nullity, shall be resolved exclusively through final and binding arbitration under the Rules of the Asian International Arbitration Centre (AIAC) by one arbitrator appointed in accordance with the AIAC rules. the seat and venue of arbitration shall be Kuala Lumpur, Malaysia.
In addition to the arbitration remedies, Insura reserves the right to seek interim injunctions, restraining orders, or other equitable relief in any court of competent jurisdiction that may be necessary or appropriate to prevent any actual or threatened infringement, misappropriation, or violation of its intellectual property rights, or any violation of the law or any covenant and obligations set under this Agreement. These remedies are in addition to any other rights that Insura may have at law or in equity.
